EVANS TOWN BOARD MINUTES
Re: Ed Gleason Situation
Is Recorded In
The Evans Town Board Meetings Eight (8) Times
Why Did Evans Town Officials Refuse To Enforce The Law?
(Militello) -he has been doing some zoning
research and Community Concern is zoned (GB) General Business
also the practice track that is flooding out
Mr. Gleason is
zoned MFR-4 when they are boarding and training horses.
Gleason, 7414 Southwestern Blvd., questioned when the
violations against his property are going to stop. He wants
the pipes his neighbor put in taken out. Mr. Gleason has been
waiting since June 10, 2003 for these violations to be taken
care of in court.
7414 Southwestern Blvd., questioned when the pipes on the
neighboring property are going to be removed and they are not
-the status of the
violations also for the neighboring property
-stated that Rt 20
is not the problem causing flooding it is the hose coming out
of the barn on the neighboring property
-manure is still in
the front yard
Edmund Gleason, 7414 Southwestern Blvd. thanked
the Chamber of Commerce for the flowers planted at the sign
Welcome to the Town of Evans@.
-commented on the 2 rusty beams & 6 foot high
pile of manure on the neighboring property
-commented that the
2 acre pond on the neighboring
property is full of water and flooding his yard
Councilman Govenettio reported that Edmund
Gleason is getting action regarding the problems he has
reported to the Town Board about his property.
Ed Gleason=s situation had nothing to d0 with
Town Officials. When he went to court it was set by the
judges and lawyers. According to the files I have, Mr.
Gleason lost his case due to the testimony of a federal
official from the Department of Agriculture.
Gleason, 7414 Southwestern Blvd., had all the same problems
but nothing was done in our court. He has tried for two years
to alleviate this problem. Saw dust and crushed stone with
dust has been dumped on the neighbors property. Saw dust was
dumped 10-20 feet from his property.
Attorney Zajas reported that the horse training track on Route
#20 neighboring Mr. Gleasons property appears that it is not
in compliance with the present Town Code relative to the
tracks maintenance and location so therefore it is a
non-conforming pre-existing property use so therefore they
very well maybe
in and to try and
force compliance with the current code of a pre-existing
property is not something that would be effective or even
Mr. Zajas, Can
You Grandfather Breaking The Law?
