Edmund Gleason, 7414 Southwestern Blvd., questioned when the violations against his property are going to stop.  He wants the pipes his neighbor put in taken out.  Mr. Gleason has been waiting since June 10, 2003 for these violations to be taken care of in court.

http://www.townofevans.org/minutes/old/031704.html

Edmund Gleason, 7414 Southwestern Blvd., questioned when the pipes on the neighboring property are going to be removed and they are not capped.

-the status of the violations also for the neighboring property

-stated that Rt 20 is not the problem causing flooding it is the hose coming out of the barn on the neighboring property

-manure is still in the front yard

Ed Gleason=s situation had nothing to d0 with Town Officials.  When he went to court it was set by the judges and lawyers.  According to the files I have, Mr. Gleason lost his case due to the testimony of a federal official from the Department of Agriculture.

 4-6-05

http://www.townofevans.org/minutes/old/040605.pdf

Ed Gleason, 7414 Southwestern Blvd., had all the same problems but nothing was done in our court. He has tried for two years to alleviate this problem. Saw dust and crushed stone with dust has been dumped on the neighbors property. Saw dust was dumped 10-20 feet from his property.

Town Attorney Zajas reported that the horse training track on Route #20 neighboring Mr. Gleasons property appears that it is not in compliance with the present Town Code relative to the tracks maintenance and location so therefore it is a non-conforming pre-existing property use so therefore they very well maybe grand-fathered in and to try and force compliance with the current code of a pre-existing property is not something that would be effective or even possible.

Mr. Zajas, Can You Grandfather Breaking The Law?

This Picture Taken Just After Drain Pipes Were Installed. Notice The Ground Is Dry (No Mud) And There Is No Water In The Area
Same Pipes As Above.
Look At All The Water Illegally Being Drained On To Ed Gleason's Property By His Neighbor.
Now Ed Gleason's Property Is Always Too Wet To Use And Sometimes Flooded!
Ed Gleason's Road Before The Problem. He Could Drive His Bulldozer Down This Road And Not Worry About Getting Stuck!
Now Sections Of The Road Are Under Water All Year Long.
In Some Places You'd Need Knee High Boots.
Survey Stakes Are Under Water All Year Long!

Ed Gleason Used Some Of His 31 Acres Of Land To Raise Oak & Maple Trees. An Adjoining Property Owner, With Friends At Evans Town Hall, Installed Drainage Pipes Which Has Turned Gleason's Property Into A Swamp! The Water Is BROWN Due To Large Piles Of Horse Manure On The Neighbor's Property. Now Most Of Gleason's Property Is Only Suitable For Raising Frogs & Cat Tails!

This Fence Is Illegal Since It Is Too Close To The Property Line

Cat Tails Have Replaced The Grass That Use To Grow Here
Many Trees Are Dead Or Dying Due Too The Swamp That Has Been Created
The Race Track Is Only A Few Feet From The Property Line
This Also Violates Town Zoning
Grass Use To Grow Here. Due To Standing Water, The Grass Has Died Off In Many Sections Of Gleason's Property.
Ed Gleason Had A Road That Went To The Back Of His Property.
It Was Usable Well Into Hunting Season.

Now Most Of The Road Is To Soft To Use Or Under Water.

Tossing A Stick Into The Road Makes A Big Splash!
