200-9. Suburban Residential Discrict (S-R).

  A.Intent. The intent of this district is to provide areas within the Town for low-density rural and semirural single-family detached residential development, farms and farm-related activities, as defined by this chapter, and other nonintensive comparable activities. In addition, this district, as the major land use district in the town, may be utilized as a land area from which other districts may be formed through the rezoning procedure required by this chapter and other applicable laws.   B.Permitted structures and uses. The following structures and uses are permitted in Suburban Residential District  (S-R):  
 
   
 
  (1)Principal structures and uses.  
 
   
  (a)Single-family detached dwelling units. Attached or built-in garages shall be deemed part of the principal structure.  
   
 
  (b)Public or private stables, provided that the area of the lot is five acres or more and the stable and all exercise tracks are located at least 50 feet from any lot line.  
 
   
 
  (c)A farm, as defined in this chapter, and buildings incident thereto.  
 
   
 
  (d)A church, synagogue or any other place of public worship.  
 
   
 
  (e)Private wildlife reservations or conservation projects.  
 
   
 
  (f)Veterinarian, small animal hospital, riding stable, kennel and the keeping of small animals, provided that any structures, pens or runways for the housing thereof are not less than 50 feet from any lot line. Further, no manure or other odor- or dust-producing substance shall be kept within 100 feet of any lot line. The manure shall be kept in tightly covered containers which shall control odors and insects.  
 
   
 
  (g)Forestry.  
 
   
 
  (h)Bed-and-breakfast establishments and tourist homes. (Special use permit required; see 200-45 of this chapter.) [Added 5-17-2000 by L.L. No. 5-2000]  
 
   
 
  (2)Accessory structures and uses.  
 
   
 
  (a)Uses and structures incidental, subordinate and related to the above.  
 
   
 
  (b)Home occupations, as permitted and regulated by this chapter.
 
(c)The office of a resident professional, as permitted and regulated by this chapter.  
 
   
 
  (d)Rooming and boarding of not more than three persons.  
 
   
 
  (e)Detached private garages and parking areas.  
 
   
 
  (f)Private gardens and greenhouses.  
 
   
 
  (g)Raising of livestock, poultry and bees on lots of not less than five acres, provided that any structures, pens or runways for the housing thereof are not less than 100 feet from any lot line and that fences or other enclosures are provided so as to keep the livestock, poultry or bees 15 feet from the lot line. Further, no manure or other odor- or dust-producing substance shall be kept within 100 feet of any lot line.  
 
   
 
  (h)Swimming pools, as permitted and regulated by this chapter.  
 
   
 
  (i)Other private recreational uses and structures.  
 
   
 
  (j)Sale and display of agricultural products grown on the premises, provided that the stand shall not exceed 300 square feet in net floor area.  
 
   
 
  (k)Windmills for the pumping of water or the production of electricity, with a tower height of 100 feet maximum, and such windmill is to be no closer than 150 feet to any property line.  
 
   
 
  (l)A greenhouse, defined as a building whose roof and sides are made of glass or other transparent or translucent material and in which the temperature and humidity can be regulated for the year-round culture of plants.  
 
   
 
  (m)Signs, as permitted and regulated by this chapter.  
 
   
 
  (n)Private and parochial schools and day-care centers accredited, when required, by New York State, when accessory to a church, synagogue or other place of public worship.  
 
   
 
  (o)Off-street parking, loading and stacking, as required by this chapter.  
 
   
 
  C.Design regulations.  
 
   
 
  (1)Principal structures and uses.
 
(a)Minimum lot area per dwelling unit: one acre.  
 
   
 
  (b)Minimum width of lot abutting a dedicated street: 200 feet.  
 
   
 
  (c)Minimum yards.  
 
   
 
  [1]Front: 50 feet.  
 
   
 
  [2]Each side: 30 feet.  
 
   
 
  [3]Rear: 50 feet.  
 
   
 
  (d)Maximum lot coverage by structures: 25%.  
 
   
 
  (e)Maximum structure height.  
 
   
 
  [1]Residential structures: 30 feet.  
 
   
 
  [2]Barns, silos and other structures: 65 feet.  
 
   
 
  (f)Minimum livable floor area, excluding attics, basements, cellars or attached garages.  
 
   
 
  [1]Under two stories: 1,200 square feet.  
 
   
 
  [2]Two stories or more: 1,600 square feet.  
 
   
 
  (2)Accessory structures and uses.  
 
   
 
  (a)Structure location.

 

   
 
  [1]From another structure: 10 feet.
